AI tools can now transcribe a sales manager's Marathi voice note, draft a WhatsApp reply in Hindi, summarise a 20-minute call and suggest the next follow-up. Used well, they give reps back hours every week. Used carelessly, they can promise things the company cannot deliver and mishandle buyers' personal data.
This article sets out practical rules for using AI in real-estate sales in India: where it helps, where a human must stay in charge, and what the Digital Personal Data Protection Act, 2023 means for the data you feed into it.

02What AI should not do on its own
- Quote final prices or discounts. Prices depend on the live price list, unit attributes and approvals. AI can show list prices from the system; it should never invent or negotiate a number.
- Promise possession dates. The date must match the RERA registration and the agreement. Any other date is a liability.
- Give legal or tax advice. AI can explain general rules with sources, such as Section 194-IA TDS, but should direct buyers to their own advisers for their situation.
- Confirm a unit is reserved. Only the inventory system can confirm a hold or booking.
- Decide on credit or cancellation. These decisions need a human with authority and a record.
- Pretend to be a person. If a buyer is chatting with an AI agent, say so clearly.

Start conservative. As you review AI drafts and see where they are reliable, widen what runs automatically. Keep a log of what the AI sent, so you can review it.
04Personal data and the DPDP Act, 2023
The Digital Personal Data Protection Act, 2023 governs how digital personal data is processed in India. The Digital Personal Data Protection Rules, 2025 were notified on 13 November 2025, with most obligations taking effect after an 18-month transition, in May 2027. Developers collect a lot of personal data: names, phone numbers, income, PAN and Aadhaar copies, family details. Under the Act, a developer deciding how this data is used is a data fiduciary.
Main obligations to plan for
- Notice and consent (Sections 5 and 6). Tell people what data you collect and why, and get consent that is free, specific, informed and unambiguous, given by a clear affirmative action. Lead forms should say how you will use the data and how you will contact them.
- Purpose limitation. Use data for the purpose it was collected for. A buyer's KYC documents collected for registration should not be used for unrelated marketing.
- Withdrawal. A person can withdraw consent, and it must be as easy as giving it. Honour opt-outs from calls and WhatsApp.
- Security safeguards (Section 8). Take reasonable security safeguards to prevent personal data breaches, and notify the Data Protection Board and affected persons of a breach.
- Erasure. Erase personal data when the purpose is served and consent is withdrawn, unless the law requires you to keep it.
- Processors. If you use an AI or CRM vendor, you remain responsible. Have a contract that limits how they process your buyers' data.
The Act's schedule sets penalties up to ₹250 crore for failure to take reasonable security safeguards. Penalties for other breaches are also significant.

05Practical rules for AI and personal data
- Send AI tools only the data needed for the task. A call summary does not need the buyer's PAN.
- Do not paste buyer data into consumer chatbots on personal accounts.
- Use vendors that state where data is processed and whether it is used to train models.
- Keep AI outputs in your system of record, not in personal WhatsApp chats.
- Give buyers a way to ask what data you hold and to correct or delete it.
- Record consent for call recording and WhatsApp messaging on the lead.
06WhatsApp agents
AI agents that answer buyers on WhatsApp are becoming common. On the WhatsApp Business Platform, businesses need the person's opt-in before messaging them, and conversations started by the business must use approved message templates. Free-form replies are allowed within the customer service window that opens when the person messages you.
- Tell buyers they are chatting with an automated assistant and how to reach a person.
- Limit the agent to approved facts: location, configurations, amenities, RERA number, visit booking.
- Hand off to a person for price negotiation, complaints and anything the agent is unsure about.
- Review a sample of conversations every week.
